These Terms of Service ("Terms") govern your use of the RallyTrak mobile app and rallytrak.com (together, the "Service"), operated by Waypoint Group Holdings, LLC ("we", "us", "RallyTrak"). By creating an account or using the Service, you agree to these Terms.
01Eligibility
You must be at least 18 years old to use the Service, or 13 or older with the permission and supervision of a parent or legal guardian. You must provide accurate registration information and keep it current.
02Your Account
You are responsible for the activity that happens under your account. Keep your password secure. Notify us at Hello@RallyTrak.com if you suspect unauthorized access.
03The Service
RallyTrak provides GPS-based stage timing for off-road rally events. You can record stages, view results and leaderboards, register for events, and (for organizers) create and manage events.
We may add, modify, or remove features without notice. We do not guarantee that the Service will be uninterrupted or error-free.
04Subscriptions & Billing
Personal Rider Subscription
The Personal Rider subscription costs $7.99 USD per month, billed through your Apple ID. The subscription auto-renews monthly until you cancel.
Cancellation
Cancel anytime in iOS Settings → Apple ID → Subscriptions (or follow support.apple.com/HT202039). Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months.
Free Trials and Promotions
If we offer a free trial or promotional rate, the terms shown at signup apply. After the trial, your subscription auto-renews at the standard rate unless you cancel before the trial ends.
Price Changes
We may change subscription prices. We will give you at least 30 days' notice and an opportunity to cancel before the new price takes effect.
05Acceptable Use
You agree not to:
- Use the Service to harass, threaten, or impersonate others.
- Submit false stage data, manipulate timing, or attempt to game leaderboards.
- Reverse engineer, decompile, or otherwise attempt to extract the source of the Service.
- Use the Service to violate any law or third-party right.
- Interfere with the operation of the Service or attempt to access accounts, data, or systems that are not yours.
Violations may result in account suspension or termination without refund.
06Event Organizers
If you create events through RallyTrak ("Organizer"), you are responsible for:
- Ensuring you have the legal right to run the event and timing in the location where it takes place.
- The accuracy of event details, courses, waypoints, and liability waivers presented to riders.
- Compliance with all applicable laws, permits, and insurance requirements for your event.
- Resolving disputes about results in good faith.
We provide the timing platform; we do not organize, sanction, or insure your event.
07Event Creation & Removal Rights
RallyTrak grants approved event organizers access to create and manage rally events on the platform. Approval is granted at our sole discretion, typically after we have reviewed and agreed to commercial terms with the organizer.
We reserve the right, at our sole discretion and without prior notice, to:
- Remove or archive any event we determine has been created without authorization, including events created by users who circumvent our approval process;
- Remove events that violate these Terms, applicable law, or our community guidelines;
- Suspend or revoke event-creation privileges from any user whose conduct or content does not meet our standards;
- Refund or decline to refund subscription fees of riders affected by an event removal, at our discretion;
- Retain or delete event data, including rider attempts and results, associated with a removed event.
08Assumption of Risk & Disclaimer
By using RallyTrak, you acknowledge that:
- You are solely responsible for your own safety, your equipment, your decisions on the course, and your ability to ride.
- RallyTrak is a timing and scoring tool. It is not a navigation aid, a safety device, a tracking-for-rescue service, or a medical device. Do not rely on RallyTrak in an emergency.
- GPS accuracy varies by device, location, satellite coverage, weather, and environmental conditions. RallyTrak's recorded location and times may contain errors.
- Heart rate readings from Bluetooth devices are not medical-grade and must not be used to make medical decisions.
- The "beacon" feature (where available) may transmit your position with a delay or not at all. Do not assume anyone is watching.
You ride at your own risk. You waive any claim against Waypoint Group Holdings, LLC, RallyTrak, and our employees, contractors, and affiliates for any injury, loss, or damage arising from your use of the Service or from any rally or off-road activity, except where prohibited by law.
09Intellectual Property
The Service, including all software, design, text, graphics, and trademarks ("RallyTrak", "Chasing Waypoints", "RallyWerks"), is owned by Waypoint Group Holdings, LLC and protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
You retain ownership of the data you submit (stage recordings, profile information, event content if you are an Organizer). By submitting data to the Service, you grant us a worldwide, non-exclusive license to host, store, display, and process that data solely to operate and improve the Service.
10Third-Party Services
The Service uses Apple, Supabase, RevenueCat, and Sentry. Your use of those services is subject to their respective terms.
11Termination
You may stop using the Service at any time. You can request account deletion by emailing Hello@RallyTrak.com.
We may suspend or terminate your account if you violate these Terms, if required by law, or if the Service is discontinued. We will give reasonable notice unless doing so would cause harm to other users or violate the law.
12Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAYPOINT GROUP HOLDINGS, LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
14Indemnification
You agree to indemnify and hold Waypoint Group Holdings, LLC harmless from any claim or demand arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
15Governing Law & Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.
Any dispute will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in San Diego County, California. You and we each waive the right to a jury trial and to participate in a class action.
16Changes to These Terms
We may update these Terms. Material changes will be announced in-app or by email at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms.
